The Small Claims Division of the Vanderburgh Superior Court was established to provide a forum for the prompt resolution of claims involving less than $6,000.00. The rules of evidence and procedure applicable to Small Claims Court are relatively informal. Although parties are free to hire attorneys to represent them in Small Claims Court, many people successfully handle their own cases without representation. Most of the landlord-tenant, debt collection and civil suits involving less than $6,000.00 are filed and resolved in the Small Claims Division of the Vanderburgh Superior Court.
The Small Claims Division holds court each day at 9:00 and 1:30 in room 223. Some days cases are set at 8:15 as well. Trials and contested motions are generally set at 10:00 and 2:30.
A Small Claims Litigant's Manual developed by the Indiana Judicial Center is available in the Vanderburgh County Law Library and is also available for sale in the Vanderburgh County Clerk's Office for $5.00 or may be accessed online at Small Claims Litigant's Manual. This manual describes the procedures and rules of evidence applicable to small claims cases and will assist the parties in filing and presenting their case to the court.
